Environmental Commission


Pursuant to N.J.S.A. 40:56A-1 et seq. there is hereby established in the Borough of South Toms River an Environmental Commission, which shall consist of seven (7) members, one of whom shall also be a member of the Municipal Planning Board and all of whom shall also be a member of the Municipal Planning Board and all of whom shall be residents of the Borough, and which shall be known as the “Environmental Commission of the Borough of South Toms River.” (Ord. 2-42.1      Creation.The following is the South Toms River Borough  Code establishing the Environmental Commission 

2-42.2      Appointment.

The members shall be appointed by the Mayor. The Mayor shall designate one of the members to serve as Chairman and presiding officer of the Commission. The terms of office of the first commissioners shall be for one (1), two (2), or three (3) years, to be designated by the Mayor in making his appointments so that the terms of approximately one-third (1/3) of the members will expire each year, and their successors shall be appointed for terms of three (3) years and until the appointment and qualification of their successors. Members shall serve without compensation. Members may be removed by the Mayor for cause, and vacancies may be filled, as provided for in N.J.S.A. 40:56A-1. (Ord. No. 2-11)

2-42.3      Powers and Duties.

The Commission shall have those powers and duties provided for under the provisions of N.J.S.A. 40:56A-1 et seq. (Ord. No. 2-11)

5-2.14  Clean Up of Dog Waste.animal license

No person owning or having the care custody or control of any dog shall permit such dog to soil, defile, defecate on, or to commit any nuisance upon any sidewalk, street or thoroughfare in or upon any public property, or in or upon the property of persons other than the owner or person having the care, custody or control of such dog.

The owner, or custodian of any dog shall be responsible for the damages done by such dog. The quarters where dogs are kept shall be clean and sanitary at all times and such as not to create a health hazard. In addition, the owner of or any person having custody, care, or control of any dog which shall soil or defecate on any property contrary to the provisions of Section 16 of this chapter, shall forthwith remove such soil, or defecation from such property and deposit the same in a garbage can or receptacle.

Any person who violates or refuses to comply with any provision of this section shall, upon conviction therefore, be liable to a penalty of not less than twenty-five ($25.00) dollars nor more than five hundred ($500.00) dollars.
